The terms behind the work.

The terms that apply to using this website and to engaging Mode Marketing Limited. Last updated 2026-05-13.

1. Site use

This site is provided as-is for general information. Using it doesn't create a contract with Mode.

2. Enquiries

Submitting an enquiry doesn't commit Mode to deliver work or you to engage Mode. Contracts are formed only when a separate written proposal is signed or a package is purchased.

3. Package purchases

Packages purchased through this site are governed by the scope, price and timeline shown on the relevant product page at the time of purchase. The price you see is the price you pay, inclusive of UK VAT.

4. Payment + delivery

  • One-off builds: 50% deposit on purchase, balance on delivery unless otherwise stated on the product page.
  • Sprints + audits: paid in full upfront.
  • Subscriptions: charged monthly, minimum terms stated on each subscription product page.
  • Timeline: starts when onboarding is complete + payment is confirmed, not when the package is purchased.

5. Intellectual property

Work delivered by Mode (websites, brand assets, copy, designs) is owned by you on full payment. Mode retains the right to display the work in its portfolio + marketing.

6. Your data

Mode processes your personal + business data in line with our privacy policy. Confidential business information shared during an engagement remains confidential.

7. AI training opt-out

Content you provide to Mode (briefs, source material, internal documents) will not be used to train any third-party AI model. Mode uses AI tools to deliver work, but those tools operate on a no-retention or no-training basis where AI services are used.

8. Acceptable use

You won't use this site or services for unlawful purposes. See our Acceptable Use Policy for specifics.

9. Liability

Mode's liability for any single engagement is capped at the fees paid for that engagement. Mode is not liable for indirect or consequential loss, except where liability cannot legally be excluded.

10. Governing law

These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
